Legal
Terms and Conditions
1. Agreement
These terms are between you and Sangam Adhikari, on behalf of the Khulla Digital Library contributors ("we", "us"). By downloading, installing or using the Khulla Digital Library app ("Khulla", "the app"), the web demo, or this website, you agree to them. If you use Khulla for a library, school or other organisation, you confirm you are allowed to accept these terms on its behalf. If you do not agree, do not use the app.
How the app handles data is covered by our Privacy Policy, which forms part of these terms.
2. Licence
Khulla's source code is released under the GNU Affero General Public License v3.0 (AGPL-3.0). You may use, study, change and share the software at no cost. If you distribute Khulla or a modified version of it, or let people use a modified version over a network, you must make its complete source available to them under the same licence. If anything in these terms conflicts with the AGPL-3.0 as it applies to the source code, the AGPL-3.0 wins.
A separate commercial licence is available for anyone who wants to sell, white-label or host Khulla without sharing their source. To ask about one, email info@sangamadhikari.com with a short description of what you want to build; the terms are set out in COMMERCIAL-LICENSE.md. Versions released before the switch to AGPL-3.0 remain under the MIT License they shipped with, and so does the app's design system package.
Third-party packages and fonts bundled with Khulla keep their own licences, listed in the project's repository.
3. Price and support
There is no charge to use Khulla. There is no subscription, in-app purchase or paid tier; the only thing sold is the commercial licence described above, which a library using Khulla does not need. Support is offered in good faith through the project's GitHub issues and the WhatsApp number and email on the contact page, without any promised response time or service level. We may fix bugs, add features or stop working on the project at any time.
4. Your data
Everything you enter in Khulla belongs to you and is stored only on your device. We have no copy of it and no way to see, restore or recover it. This means:
- Backups are your job. If a device is lost, damaged, reset or reinstalled, or if browser storage is cleared, any records not backed up are gone. Use Settings → Backup regularly and keep the file somewhere safe.
- The web demo is for trying Khulla out. Its data lives in your browser and can be wiped by the browser at any time. Do not rely on it for a real library's records.
- Check before you restore. Restoring a backup replaces everything currently in the app.
5. Your responsibilities
When you use Khulla to run a library, you are responsible for:
- collecting, storing and using member and staff information in line with the privacy and data protection laws that apply to you, including consent for children's records where required;
- the accuracy of your records, including loans, due dates, fines and payments, and for any decisions you make based on them;
- checking that fines, fees and lending rules you set are lawful and fair where you operate;
- keeping staff passwords and recovery codes private, and securing the devices and backup files that hold your data.
6. Acceptable use
You agree not to use Khulla, the web demo or this website to:
- break any law or anyone's rights, including privacy rights;
- store information you have no lawful basis to keep, or information obtained without the person's knowledge where that is required;
- interfere with this website or the services that host it, or try to gain access you are not entitled to;
- pass off a modified version as the official Khulla release (see the next section).
7. Name and logo
Neither licence covers the Khulla name and logo. You are welcome to say your library uses Khulla, and to fork and change the software. If you distribute a modified version, please give it a different name and icon, or make clear that it is modified and not the official release, so people know who to ask for help.
8. Third-party services
Khulla may be downloaded from Google Play, GitHub or other stores and hosts, and this website loads release details from GitHub. Those services are run by others under their own terms and privacy policies, and we are not responsible for them. If you got Khulla from Google Play, Google's terms for Google Play also apply to the download.
Links from the app or this website to outside sites are for convenience. We do not control those sites.
9. Updates
New versions may add, change or remove features. We aim to upgrade your existing database safely, and the app refuses to open a database made by a newer version rather than risk damaging it. Still, take a backup before every update.
10. No warranty
Khulla, the web demo and this website are provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
We do not promise that the app will meet your needs, work on every device, or be free of bugs, or that data will never be lost.
11. Limitation of liability
To the fullest extent the law allows, in no event will the authors, copyright holders or contributors be liable for any claim, damages or other liability, whether in contract, tort or otherwise, arising from, out of or in connection with Khulla or its use. This includes loss of data, records, income or goodwill, and any indirect, incidental, special or consequential damages, even if we were told they were possible.
Some places do not allow certain warranties to be excluded or liability to be limited. Where that is the case, these limits apply only as far as the law permits, and nothing in these terms removes rights you have as a consumer that cannot be waived.
12. Stopping use
You can stop using Khulla at any time by uninstalling it. Take a backup first if you may want your records later; see the Privacy Policy for what uninstalling removes on each platform. Your rights under the AGPL-3.0 continue as long as you meet its conditions.
13. Governing law
These terms are governed by the laws of Nepal. Any dispute will be handled by the courts of Nepal, unless the law of the country where you live gives you the right to bring it there. Before going to court, please contact us so we can try to sort it out.
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term straight away, we have not given up the right to enforce it later.
14. Changes to these terms
We may update these terms, for example when Khulla gains a new feature. The date at the top shows when they last changed, and the history is public in the project's repository. Continuing to use Khulla after a change means you accept the updated terms.
